CROSSIA Terms of Service

These Terms of Service (“Terms”) set forth the conditions for using “CROSSIA” and related applications, websites, events, digital content, and other related services (collectively, the “Service”) provided by Gakugeki Inc. (“we,” “us,” or “our”). Users agree to these Terms before using the Service.

 

  1. Scope of Application

  2. These Terms apply to all relationships between users and us regarding use of the Service.

  3. Rules, guidelines, notices, and individual terms posted within the Service or on our website form part of these Terms.

  4. If any individual terms conflict with these Terms, the individual terms shall prevail.

  5. Definitions

 

For the purposes of these Terms:

 

  1. “User” means any individual who browses, uses, purchases, participates in, or attempts to use the Service.

  2. “Account” means the identification information created or linked for a user to use the Service.

  3. “Coins” means prepaid or similar digital units used within the Service to obtain tickets or other designated digital goods or services.

  4. “Tickets” means rights required to participate in or use VR autograph events, VR photo sessions, and other experience content.

  5. “Content” means all information or expressions provided through the Service, including characters, images, videos, audio, 3D data, signatures, text, events, UI, and software.

  6. Eligibility

  7. Users shall use the Service at their own responsibility.

  8. Minors must obtain consent from a parent or legal guardian before using the Service.

  9. We may restrict use of all or part of the Service based on age, region, laws, platform policies, content policies, or other factors.

  10. Accounts

  11. Users shall provide and maintain accurate and up-to-date information.

  12. Users are responsible for managing their account information, login credentials, and linked information.

  13. We shall not be liable for damages caused by unauthorized use of an account unless due to our willful misconduct or gross negligence.

  14. Users must promptly notify us if they become aware of unauthorized use of their account.

  15. Coins, Tickets, and Purchases

  16. Users may obtain coins or tickets through methods specified by us or the platform.

  17. Conditions such as pricing, usage, validity period, and refund policies shall follow the information displayed at purchase, applicable individual terms, laws, and platform rules.

  18. Coins are not legal currency, do not accrue interest, and may not be redeemed, transferred, pledged, or inherited unless explicitly permitted by us. The validity period, expiration, and handling upon termination of the Service shall be determined separately by us or the applicable platform.

  19. Tickets and other rights may not be transferred, resold, exchanged, or otherwise disposed of without our permission.

  20. Except where required by law, where refunds are permitted under applicable platform rules, or where attributable to our fault, purchases of coins, tickets, or digital goods are non-refundable and non-cancelable.

  21. Where applicable, Meta or other platform payment and refund rules shall take precedence.

  22. Changes to the Service

  23. We may change the content, specifications, methods of provision, pricing, features, or design of the Service without prior notice.

  24. We may suspend, interrupt, or terminate all or part of the Service for maintenance, failure response, legal compliance, security reasons, or business needs.

  25. We shall not be liable for damages resulting from the above unless due to our willful misconduct or gross negligence.

  26. Intellectual Property

  27. All intellectual property rights related to the Service and Content belong to us or legitimate rights holders.

  28. Users may not reproduce, distribute, transmit, modify, or otherwise use Content beyond legally permitted personal use.

  29. Use of the Service does not grant users any transfer or license of intellectual property rights except as explicitly stated.

  30. User-Provided Information

  31. Users guarantee that information they provide does not infringe any third-party rights.

  32. Users grant us the right to use such information as necessary for operation, display, maintenance, improvement, and legal compliance.

  33. We may remove or restrict such information if it violates laws or these Terms.

  34. Prohibited Conduct

 

Users shall not:

 

  1. Violate laws, public order, these Terms, or platform rules

  2. Infringe rights or interests of us or third parties

  3. Record, reproduce, or distribute Content without permission

  4. Illegally obtain, resell, alter, or duplicate content or experiences

  5. Engage in hacking, reverse engineering, or unauthorized automation

  6. Conduct fraud, impersonation, or abuse payment/refund systems

  7. Engage in harassment, discrimination, or harmful behavior

  8. Interfere with Service operations

  9. Engage in any conduct deemed inappropriate by us

  10. VR Usage Notice

  11. Users must ensure safety and follow device guidelines when using VR.

  12. VR use may cause discomfort; users should stop use as needed.

  13. We are not liable for VR-related injuries or damages unless due to our willful misconduct or gross negligence.

  14. Measures for Violations

 

We may suspend accounts, restrict use, revoke rights, delete content, deny refunds, or take legal action if users violate these Terms.

  2. We do not guarantee fitness, accuracy, availability, or security of the Service.

  3. We do not guarantee third-party content or events.

  4. VR experiences may differ from real-world interactions.

  5. Limitation of Liability

  6. We are not liable for damages unless due to our willful misconduct or gross negligence.

  7. Where liability cannot be excluded, it is limited to the total amount paid by the user in the past 12 months.

  8. We are not liable for indirect or consequential damages unless required by law.

  9. Anti-Social Forces

 

Users represent that they are not associated with anti-social forces.

 

  1. Notices

 

We may notify users through the Service, email, or website.

 

  1. Assignment

 

Users may not transfer rights or obligations without our consent.

 

  1. Severability

 

Invalid provisions do not affect the validity of the remaining provisions.

 

  1. Governing Law and Jurisdiction

  2. These Terms are governed by the laws of the State of Delaware.

  3. Any disputes shall be subject to the exclusive jurisdiction of courts in Delaware.

  4. However, mandatory consumer protection laws may override this provision.
